Tenants and landlords involved in an unlawful detainer action must participate in a mandatory settlement conference. The majority of tenants are unrepresented and low-income, and many have limited proficiency in English or are limited by mental or physical disability. They struggle to understand the settlement process, the risks faced at trial, and the terms of proposed settlements. Without representation tenants often accept settlements that are not much better than losing at trial.
At the clinic hosted by Community Legal Services in East Palo Alto (CLSEPA), volunteers will (a) provide individual, one-on-one advice, including possible settlement options, consequences of going to trial, defenses, etc; (b) negotiate with landlord’s counsel or pro per landlords over the course of 2 to 3 hours; (c) hopefully settle the eviction dispute and put it in writing; and (d) assist the tenant as the tenant appears in court to enter the settlement.
Mandatory settlement conferences are held every Thursday, 8:45 am-12:00 pm, at the San Mateo County Courthouse, 400 County Center, 4th Floor, Redwood City, CA, 94063. This clinic can be staffed by associates. Volunteers will need to commit to an entire morning session but need not commit to come weekly.
Webinar training is available, and a 1 hour live training eligible for MCLE credit is also available.
Please email firstname.lastname@example.org if you are interested.
