Implicit Bias, Structural Bias, and Implications For Law and Policy

Justice Goodwin Liu, Associate Justice of the California Supreme Court, will deliver a lecture, followed by a fireside chat and Q&A, on implicit and structural bias, with implications for law and policy.  In almost every organizational setting, today’s leaders are grappling with challenging issues of diversity, equity, and inclusion. “Implicit bias” and “structural bias” have become familiar terms in everyday discussions about diversity, but the terms are not always well-defined. Drawing on recent work convened by the National Academy of Sciences, Justice Liu will discuss the evidentiary basis for implicit bias and structural bias, as well as possible legal responses and mitigation strategies applicable to a variety of institutions and organizations.

The top three complaints about litigation are cost, time-to-resolution, and unqualified decision makers.  The problem gets exacerbated in technology/IP disputes because even a single-patent case can cost $6M in attorney fees and take 5 years through Fed. Cir. appeal.  Arbitration can address these concerns.  This seminar will cover the fundamentals of arbitration, what it looks like in technology and IP disputes, and what to watch out for when handling an arbitration case.

Is Unauthorized Copying an Infringement or Fair Use? Are the Rules Different for Content and Tech?

In the past few months, the U.S. Supreme Court has released blockbuster decisions about the (unauthorized) use of photographs (Prince / Andy Warhol) and product designs (Jack Daniels), by unlicensed entities. These follow an earlier major decision (Google / Oracle), relating to computer software, from 2 years ago. In every case, the issue was about the availability and scope of the “fair use defense” against copyright or trademark infringement. The latest (content) cases had similar outcomes, but radically diverge from the earlier (tech) case. How will these developments change the businesses of art, social media, publishing, merchandising (on the one hand) and software and AI (on the other hand), either per se, and/or in a converging world?

This is a joint program of the Asian Pacific American Bar Association of Silicon Valley, and the Licensing Executives Society of Silicon Valley.
